Mediation, What is it & How it works
Mediation is a process where a third neutral party assists you the client in reaching a
resolution.  The courts recognized that an imposed judgment is not always the most
productive nor is it the most preferred many times, by either side which is why some court
cases are referred to mediation.  Lemon Law cases are one example.  In mediation the
parties who are directly affected by the issue and the outcome retain the power and ability
to decide how their lives will be impacted by the outcome.  Many times the resolution is
focused upon the healing of a relationship.  Mediation is used in many areas around the
world today by both countries and courts alike.
Selecting a Mediator
Selecting a Mediator can be difficult especially in New York where there is NO
regulation or licensor to over see Mediators.  When selecting a mediator you should
always look into his/her background, affiliations and credentials.  Many mediators are
self recognized as to their professional ability.  Check for yourself to see if this
professional background comes from an accredited institution and NOT from someone
who is a self proclaimed teacher or educator of such.  Time in the business does not
equate to actual experience nor competency.  Be specific as you check the mediator's
background and education.  The more diverse the background the more the mediator
has to offer you the client.  All of my training is documented from Accredited
Universities and our Court System as can be found on my "Professional Background"
tab.  I have documented hours doing actual court cases.
